Arizona: I foreclosed on house, can mortgage company come after me for defiency? I had a first and second loan from the same company for an Arizona property. The sent me a 1099-A already. This was a rental property, single-family residence. Question is, can they come after me for the difference after foreclosure (the deficiency) ? I read a few sites that say no they cannot. But the mortgage company insists they can. They claim they "do not know" about any AZ laws that prevent them from coming after me. I have called them over 30 times, and get a different answer each time! Anyone here very knowledgeable on this? I appreciate ANY help! I am getting the runaround from this company. guidelines for property ownership in Arizona. What happens if someone's name is on title but not mortgage? My sister in law and her husband own a house together in Arizona. The situation in their marriage is not good. He is abusive and she wants out. Both of their names are on the title but only his name is on the mortgage. She is afraid that if she leaves and he lets the house go into foreclosure, the bank can come after her and affect her credit negatively. I do not believe that this is the case. I think that the bank will repo the house, but only his credit will be affected. He is trying to get her to stay by saying that if she leaves, her credit will be ruined because he will let the house get repo'ed. Can someone give me a little clarification on this matter? If I live in California, how do I get a job in Arizona? I am seriously considering moving to Arizona. I would like to buy a house. I refuse the pay a mortgage in California. How do I find out which companies are productive and that are hiring? How do I interview? How do I know what city? I know people make moves like this all the time, I just can't figure out how. What is the recourse for landlord when the tenant breaks the lease in Arizona? I have a tenant who signed a lease to rent my property for one (1) year. They now want to break the lease to move back to their home state. They said they would pay for another month, and let the security deposit cover one other month. The lease is finished in February. Further, they said they check and found my house is going into foreclosure. Their attorney told them to stop paying, they don't to pay the rent. Is the Dems' Housing Bill Intentionally Racist Since it Bailouts Out Hispanic Heavy Calif, Arizona, & Nevada California is the state with the highest % of its mortgages in default. Arizona and Nevada are not far behind. The defaults are disproportionately hispanic compared to the rest of the US. Does this surprise you given that Dems count on the hispanic vote? Why is the rest of the US bailing out these states? Shouldn't states bailout their own people? I own a home with my ex as joint tenants but she left. What rights do I have to get her to pay half the mortg? She moved out of the state 7 months ago but I just found out she's in a new relationship and isn't coming back. I've been barely able to pay the mortgage and utilities since but she hasn't provided a quitclaim deed or anything. I would like to refinance to remove her from the mortgage but I don't know my rights. Is she still legally liable for half of the mortgage since she left? Pulling 2nd Mortgage on FHA Loan? Hello, I've recently made a home purchase and will be closing on my new home in about three weeks. Since my credit score wasn't high enough to qualify me for a conventional loan, but income was, the builder's finance company was able to approve me for an FHA loan since it was also my first home purchase. My question is I'd like to put a pool in, I live in Arizona and it's a necessity in this state :) and was wondering if there are any stipulations as far as the amount of time I have to pay on the loan before I can pull a 2nd mortgage on it or refinance it to get some of the equity and put the pool in and make a few upgrades to the home?

A Mortgage related Question.? My broker is getting me a Mortgage from First Magnus Financial Company of Arizona. I never heard of this company. I'm owed money from a friend in Arizona, and I live in the Philippines. There was no written contract, only tons of emails and yahoo chat discussions, all saved. This is for previous work done for him on a project. He seems to be avoiding me, although had said he will pay me soon. He said he knows how important the money is to me and my family (no contention), and intended to pay me and his debts to others when he obtains an imminent mortgage loan. That time has come and gone, and he now doesnt answer emails/chats/phone calls, etc. This is a case of where the money is very important, not just the principle of it. It feels like he has been deceptive and deliberately delaying and avoiding. It now feels like theft. What recourse would I have short of physically having someone try to take whats due? Is the saying 'nothing in writing- means no chance' apply here? Does anyone have any other suggestions? (I had not been rude or threatening up to this point in my emails to him, only asking what's happening...come on! Please dont ignore me..etc.) What does the law say about it all?..Help!!
Is it legal for our landlord to do this to us? I live in Arizona. Basically we've been renting month to month a house from our landlord, and recently we found out he hasn't been paying mortgage and we have less then a month to leave. I guess for the last four months he hasn't been paying it and letting the house go under foreclosure. Can he legally take our money like that? Oh and all those months he didn't pay mortgage we were still giving him money, not knowing he was letting it go.

If I refinance my home to cash out equity and end up foreclosing in the future, what can happen to me? I like many others am in financial trouble and am having problems paying my mortgage. I'm thinking about refinancing my home (for no more than it's current market value) and taking my equity so I can pay off my car and a credit card. If I do that, and still end up facing foreclosure in the future - what can happen to me besides having my credit ruined? I live in Arizona - the law here states that - "A lender may not bring a deficiency suit against a person who lost a property that is 2.5 acres or less at a foreclosure provided the property is a single one-family or a single two-family dwelling." Moving to Arizona? Good or bad idea? So I've been living in Denver for the past 8 years. I'm pretty bored with it. The nightlife is old, boarding is old...well the winters are getting old! Granted the state is gorgeous but I just need change I feel. I've been in the mortgage business & maybe that's why I want to get the heck out of here. I can't seem to find a job outside of the mtg biz here in Denver. Not sure what I want to get into either. I love dealing with people, working out & being active. I'm good looking so it's easy to meet people. However I'm not a fake or do I feel like I'm better then most people. I grew up in the Midwest & I've held my values. Would Arizona be a silly idea? I love Chicago but it's too big. San Diego would be awesome but the cost of living is out of control & I'd like to be able to live. I am based away from my primary residence (owned) for the next year, can I deduct my rent? ? I own a home in Fort Lauderdale, FL. My company has offices nearby in Miami which is supposed to be my permanent base. The first deal I received was thru some loan officer located out of Arizona who gave me a 6.5% rate with 2 points. I heard this was a horrible deal so I decided to shop around especially after hearing that you have 14 days from the first mortgage inquiry to shop around and have other lenders pull your report without it harming your credit because it will be considered one. I then received a quote yesterday thru quickenloans.com but after reading some of the questions and answers that were posted about others experiences I was very skeptical even though they gave me what seemed like a good or better rate than the first guy. For example they gave me a 5.6...% (there were two more numbers after the 6 can't remember) with 2 points or a 6.25% w no points. I am also interested in seller concession so closing cost and points wont be paid out of pocket. Not only am I skeptical about the stuff I read here about quickenloans but they are also asking for $350 committment fee that will be refunded at closing if we decide to close with them. So if we dont close with them then basically that money is non refundable, which has me feeling trapped and I dont really like feeling that way. What I dont want to happen is I agree to pay that committment fee and then at closing theres a whole bunch of other fees that I did not agree or know about and I back down and they keep my $350 fee. Which $350 is not going to kill me but who wants to give away money? So I decided to not pay that fee but I still have them in mind just in case. I called JP Morgan Chase bank and they approved me with different rates. They offered me 5.875% with 2.3..( theres two more numbers after the 3, forgot...again!) points and a 6.125% with 1.5 points. I know Chase is a reputable bank that has been around for a long time and I kind of trust them better then quicken loans but quicken loans does have the better rates so basically im stuck???? I would like some type of advice on what I should do if worst case senerio where it's either one or the other I have to choose from. I am still going to shop around because I know I can probably do better. Here are the basics: -annual combined income: a little over 100k yearly. -401k combined: 17,364 -been at our jobs over 2 years both. -combined monthly bills: a little under 1000.00 monthly. -all three credit scores for him: experian: 643, transunion: 634, equifax: 610 -mine: experian: 684, equifax: 672, transunion: 649 Thanks so much!

And I seriously doubt CHAD will move into the neighborhoods the Hispanics live in. The departures were first felt at stores and businesses that cater to such immigrants. Sales suddenly dropped. Now, apartment complexes, especially those with affordable rents in neighborhoods with large immigrant populations, are feeling the effects. Individuals and entire families are moving, leaving behind empty apartments that can't be filled. Some renters are handing over their keys and breaking leases because they've lost their jobs due to the sanctions law and can't pay the rent. Others are simply skipping out in the middle of the night. I've seen $70,000/year and up claimed for aircraft pilot wages. In reality, for most pilots, much less? I have talked to a few commercial pilots in the Arizona and Utah area that claimed they made $35,000 to $50,000 per year. Much less than a plumber. I would like to study for commercial flight, but I need to earn at least $60,000 to pay the mortgage on my home and payments on my car. What venue should I study? And how many hours to get to that earning? Unfortunately, I DO have these payments now. I am older and have been in my career for 15 years. is the price of a new house negotiable after signing the contract? i've signed a contract for a new home in phoenix arizona back in january. now with the mortgage rate climbing and the housing market cooling (quite rapid here in phoenix), i'm worried the value will drop and i'll end up losing money. (the houses like the ones i looked at was going for less than 200 grand three years ago and when i signed the contract, the price was at almost 300 grand)(and when i get to sell the house later, i'm afraid i won't even be able to sell it for the price i'm paying which is 300K) Should I try to back out on the contract and lose the deposit, which is a whopping 5 grand, or should i just go ahead and close on this house even if i don't feel right? and is it too late to negotiate the price of the house since i've already signed a contract? it's a new home that's being built, so i don't know if a negotiation is an option at all.. but any experts out there, please help.. any advise will be greatly appreciated..
Who pays for Title insurance at closing: buyer or seller? I know there are two policies: one for the buyers lender and one for the buyer. Why would a seller have to pay for either one of these when the buyer and his mortgage lender are the ones benefitting. Or are these always negotiable between buyer and seller as to who pays? What if the seller took a low ball offer and doesn't want to pay for title insurance? The condo is in Arizona.

The specifics are that my wife and I were seperated (not legally) six years ago.While we were apart, I began looking for a house to purchase. The mortgage co. had my wife sign a quit claim deed because the future of our marriage was unclear. She later moved in for approximately five years. Now she has moved out and we are possibly facing divorce. As far as I know, the quit-claim deed is still in force. Can she legally get around this deed and if so, how?

Any tips for losing post partum weight? My newborn is 4 weeks old. I'm nursing, but anxious to lose this weight. I lost it all plus 5 pounds with my first one in 5 months. I live in Arizona, so it is way too hot to walk/run outside, even in the early morning and late evening, so that option is out. We can't afford a gym. I know it is only $20/month or so, but we just bought a house and we will be holding 2 mortgages. Don't worry, we can afford that, but no extras like gym memberships till our house sells. I am dieting, but I don't want to compromise my breastmilk. I'm just careful of what I eat. I do sit ups at home along with leg lifts. Is there anything else I can do till it cools down outside? Earned Income Credit denied due to Rental Income? Hi all, I resided in Wisconsin for all of 2007, but owned a home in Arizona as well. I rented this property out for all of the year and made more than the $2,900 "investment" income ($12000 total), which TurboTax says disqualifies me from the EIC. I only made $8000 at my job in Wisconsin, bringing my total income to about $20,000 combined. The rental income barely covered the mortgage payments for the Arizona home. Is there any way that I can still claim the EIC? My refund without the EIC is $1200, versus $4000 with the EIC.

housing bubble? i've signed a contract for a new home in phoenix arizona back in january. now with the mortgage rate climbing and the housing market cooling (quite rapid here in phoenix), i'm worried the value will drop and i'll end up losing money. (the house i looked at was going for less than 20 grand three years ago and when i signed the contract, the price was at almost 30 grand) Should I try to back out on the contract and lose the deposit, which is a whopping 5 grand, or should i just go ahead and close on this house even if i don't feel right? and is it too late to negotiate the price of the house since i've already signed a contract? it's a new home that's being built, so i don't know if a negotiation is an option at all.. but any experts out there, please help.. any advise will be greatly appreciated.. oh my gosh, i meant to say 200K and 300K.. yeah.. i guess you really can't buy even a piece of land with that money.. ^^ anyways, i meant that if i were to buy a house exactly like the one that is being built, then it would have cost me around 200k instead of 300k three years ago.. that's what i was trying to say.. ^^
should i consider foreclosure on a rental property? This is my situation. My wife and I were kinda forced into buying a home in Arizona. We had planned on moving out there, but things changed and the builder would not let us back out. We explained this to the broker, but they still qualified us and the builder got his money. Fortunately, we were able to get renter into the home, us still having to foot about $800 bucks out of pocket to complete the monthly mortgage. We were able to buy a house in Ca this year. I had to use my 401k from my last employer, and now we have to ante up the penalties and taxes due on that. So, now we are looking at complimenting the rental property's mortgage ($1000 a month, because the lease is up in July and the renter's want to pay $200 bucks less), $500 bucks to the IRS (payment plan for the penalties on the 401k), $100 bucks to the State (payment plan for taxes owed also), our Mortgage of $3,500.00 on our current home. my question is, should i dump my rental property and lose it to foreclosure?

Florida Home Purchase - Mandatory to Have Husband and Wife on Deed? Hello. My wife and I are going to purchase a house in Flordia. My credit is rock solid - her's is improving. I want to buy the house under my name only and hold the mortgage in my name only (deed and mortgage). The reasons are two fold: (1) We want to improve her credit and (2) when we buy investment property in Florida we would like to put one home entirely in her name. I want to make sure that when we buy an investment home in her name that the total balance of our primary residence will not show up on her credit report. She wants to qualify for an investment home purchase with her income and credit. The new home builder we are buying from is saying florida law dictates that a husband and wife must be on the contract, the mortgage application and the note. Is this true? Seems strange to me - this is NOT the case for California, Arizona and Georgia (we have investment property in each state). Thank you.

Is it any wonder Americans are outraged over the current illegal immigration situation? While our government winks and nods at Mexico, we’ve watched as illegal immigrants are afforded more and more rights in our society than American citizens - American citizens who happen to get stuck with the bill to pay for all of this generosity and are hauled off to prison if we dare to think of breaking any of the laws that illegal aliens receive a free pass for breaking. Our rewards for being Americans and legal American citizens are higher taxes, higher crime rates, lower wages, higher insurance premiums and on and on while illegal aliens are rewarded for their crimes against our borders and our society with: Free health care - U.S. taxpayers pay the medical bills for illegal aliens yet the cost of most American’s monthly health insurance premium for even a small family has now exceeded their monthly mortgage payment and if we fail to pay for our insurance and need medical care, our home will have to be sold to cover the costs. The right to be above the law - Illegal aliens can hide in ’sanctuary cities’ that say, “we care more about the rights of criminal aliens than the rights of our own citizens” yet American criminals are not afforded a place to hide, in fact, they are hunted down. In-state tuition - Senators Hillary Clinton, Dick Durbin, and other members of our Congress are proud sponsors of the illegal dream yet American children have to pay more for their college tuition than their illegal counterparts as some states have already implemented in-state tuition for illegal aliens in direct violation of our federal law. Day laborer centers - American taxpayers fund illegal day laborer centers yet there are no ‘gathering places’ being built for unemployed American workers. No ID necessary - “The stigma and humiliation of constantly proving lawful status is unacceptable”, says the ACLU yet Americans are expected to show 2 forms of verifiable ID to obtain a driver’s license. Fair share of Katrina disaster aid - Hillary Clinton - defender of the illegal alien, made sure that illegal aliens got their ‘fair share’ of the Katrina disaster aid paid for courtesy the American taxpayer. Using our courts to see that crime pays - 2 illegal immigrants won an Arizona ranch in court. Do you think an American trespasser could get that lucky in court? Turning our sense of right and wrong on its head - The Minuteman Project and other anti-illegal immigration groups are targeted as bands of racists and even called ‘vigilantes’ by our President and ‘bigots’ by a member of the U.S. Senate. Americans who are trying to help the border patrol, because of our government’s total disregard for the citizens of this nation, are rewarded by being vilified by the very officials failing to live up to the office they occupy. In this topsy-turvy world, criminals are now accepted as the victim and law-abiding citizens are handed the bill and openly accused of racism if they disagree. Or arrested if they dare to protest. Our Border Patrol agents languish in prisons while known drug smugglers are given immunity. And now, American citizens can expect to face prison time for small amounts of marijuana while illegal aliens can possess a quarter of a ton - and bring it across an international border - with absolutely no ramifications? I believe around 620 for both husband and wife. --Moving from Calif. to Arizona. --Wife will have same job when moving to AZ--make about $2,400 month. --Husband will not have job yet when wife moves. Plans to move once a transfer on current job goes through. Will visit on some weekends. Do all USA Senators have problems with telling the truth? With economic troubles dominating the race, McCain opened the new line of criticism against Romney at his first event of the day in Fort Myers, Fla., and sought to shift the campaign back to his strength, national security, and away from Romney's, the economy. First, he slapped at Romney without naming him during a question-and-answer session with Floridians, saying: "Now, one of my opponents wanted to set a date for withdrawal that would have meant disaster." Minutes later to reporters, the Arizona senator was more direct: "If we surrender and wave a white flag, like Senator Clinton wants to do, and withdraw, as Governor Romney wanted to do, then there will be chaos, genocide, and the cost of American blood and treasure would be dramatically higher." Asked about the comment in Land O' Lakes, Fla., Romney bristled. "That's dishonest, to say that I have a specific date. That's simply wrong," he said. "That is not the case. I've never said that." The former Massachusetts governor added: "I know he's trying desperately to change the topic from the economy and trying to get back to Iraq, but to say something that's not accurate is simply wrong — and he knows better." Later in Sun City, Fla., McCain stuck to his assessment and said: "The apology is owed to the young men and women serving this nation in uniform." He said he was quoting Romney as favoring a "timetable" for withdrawal and argued that he was not misquoting Romney, saying, "Clearly, the impression was that he was ready to set a date for withdrawal." But Romney quotes circulated by McCain's campaign didn't show Romney making that exact comment — nor did aides back up McCain's earlier comment that suggested that Romney "wanted to set a date for withdrawal." In an interview with ABC News in 2007, Romney said: "There's no question that the president and (Iraqi) Prime Minister al-Maliki have to have a series of timetables and milestones that they speak about. But those shouldn't be for public pronouncement. You don't want the enemy to understand how long they have to wait in the weeds until you're going to be gone." While Romney has never set a public date for withdrawal, he has said that he agrees with Gen. David Petraeus, the top U.S. commander in Iraq, that U.S. troops could move to more of an oversight role in 2008. McCain, for his part, has been a staunch supporter of the Iraq war and advocated more troops on the ground for years before Bush embraced that position last year and ramped up the number of U.S. forces in Iraq. The buildup helped curb violence in Iraq, and McCain has not been shy about claiming credit for the strategy's success. Romney aides labeled McCain's charge "stunningly false," while McCain aides portrayed his Iraq comments as part of a broader effort in the coming days to question Romney's leadership, foreign policy experience and judgment. A former venture capitalist and business consultant, Romney has spent the past week arguing that he is the Republican best able to right a troubled economy, given his 25-year record in the private sector. He's argued that McCain, who has spent much of his life in the military and in Congress, doesn't have the qualifications necessary to lead the country out of a potential recession. McCain, in turn, has sought to beat back Romney on the issue by arguing that a president needs to be ready to lead and qualified on both national security and economics, and he offers both — despite having previously acknowledged that the economy is not his strongest suit. He also sought to rebut Romney's criticisms in an unusual fashion: he dispatched high-profile surrogates to talk with the press corps traveling with the former governor. Why do people constantly say Republicans are against clean air? Pelosi opposes EPA clean air decision WASHINGTON - House Speaker Nancy Pelosi told the Environmental Protection Agency on Friday that Congress would closely scrutinize its decision to reject California's request to tighten rules on greenhouse gas emissions. ADVERTISEMENT Pelosi, D-Calif., said she strongly disagreed with the agency's rationale for the decision and would support an investigation by Rep. Henry Waxman, D-Calif. He is seeking all documents related to the state's request for a waiver to implement fuel efficiency rules for vehicles that it says will work faster than the federal government's. "The actions of the EPA in denying the California request cannot help but raise serious questions about the support of the Bush administration for state efforts to safeguard the environment and the health of their residents," Pelosi wrote in a letter to EPA Administrator Stephen L. Johnson. EPA's announcement Wednesday that it would bar California and at least 16 other states from regulating tailpipe emissions from new cars and trucks was swiftly criticized by state leaders and environmental groups. Several states have said they will appeal the decision. Johnson said California's emissions limits were not needed because Congress approved energy legislation raising fuel efficiency standards nationwide to an average of 35 miles per gallon by 2020. California officials say their state's law was tougher and acted faster. White House deputy press secretary Tony Fratto defended Johnson's decision Friday: "He made that based on what he thought was best for the nation in addressing this issue, and he pointed to the really significant policy changes that are going to come through from the energy bill that we signed last week." "There's always a balance, and he (the president) does have a healthy respect for states' rights," Fratto added, "but these decisions need to be made in terms of what is best for the country." It was the first time the agency had completely denied a Clean Air Act waiver request from California after granting more than 50. The state adopted tailpipe standards in 2004 that would have required car makers to reduce greenhouse gas emissions by 30 percent in new cars and light trucks by 2016. Under the Clean Air Act, California needed a waiver to put in place the rules, and other states could then adopt them, too. Twelve other states — Connecticut, Maine, Maryland, Massachusetts, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Vermont and Washington — have adopted the standards. The governors of Arizona, Colorado, Florida and Utah have said they also plan to adopt them. I need a loan for building my home,but i have really bad credit? I need a loan for building my home,but i have really bad credit. My wife and i are in the process of building our home in missouri,the problem is im not sure how to find any finace companies that will even talk to me about a small home loan for building. Im only asking for about 25,000 and plan on doing all the work myself. Two years ago we were living in michigan and owned our own home,but when economy went to china,my wife lost her job as a school teacher,that left me to be the sole bred winner for paying mortgage and the rest of the bills.It went ok for awhile untill we discovered the possibility of my wife ever getting another teaching job in michigan was slim to none,nevertheless after a while we were forced to put our house on the market and move to arizona,where she could get a job,we made the payments till we could no longer and lost the house to foreclosoure.Now a friend of mine has givin us ten acres of land in missouri. joint ownership of property with brother who won't move on.? Me and my brother purchased a house .We hold the title in joint ownership with right of survivorship. I got married and was planning to move on with my wife. We have a house being built and plan on moving in soon. The current house that I live in with my wife. I pay for entirely. I finally got my brother to move out after several months of being shorted money then eventually not getting any money from my brother for his half. He left me owing me thousands of dollars. I have tried to reach him several times to get him to sign a quick claim deed. He wont get back to me. We owe 114,000 on the mortgage and 65,000 on a home equity loan. The house is worth only about 150,000 after the market dropped. I want to refi so I can lower the payment and rent the place out. What could I do to get him off the title if he wont sign the quick claim deed. What are my options for short sale or foreclosure if I cant carry the house any longer. What will happen to me if I foreclose. The house is in arizona.
Why won't my house sell (asked before but with more info this time)? Okay, I asked this question earlier but evidently didn't share enough specific information. My dilemma: my house has been on the market for 13 months. I have lowered the price dramatically during that time but still no offers. It is located about two hours north of Phoenix, Arizona, in a beautiful retirement community called Prescott. The home has been freshly painted on the outside, has absolutely stunning views of two well-known mountains, and has pool, tennis court and trailhead access. My husband's relocation company has recommended another $50K price reduction. Understand that this market is very slow, with approximately 200 other homes somewhat similiar in square footage, lot size, etc. Some are priced higher, some lower. So what can I do to sell this house? We're now paying temporary rent where we are now (in the Northeastern part of the country) as well as the mortgage on this house.
