I need a mortgage lender in Missouri!? We are looking to buy a home and we have a lender but would like to know about other options without having my credit ran all over the place. We had a bankruptcy discharged in jan/03 and a foreclosure in june/03. Our credit score ranges from 618 to 545-there is a discrepency with this particular credit company and I have papers to prove it. We will be financing around $170,000 and my current lender is offering me 7.25 interest rate with closing costs around $3500 and no money down with a Fannie Mae loan. Any suggestions or offers?
Capital gains tax based on original price or refi mortgage? We live in Missouri, in the US, and purchased our first home for $43,000 in 1997. It was our primary residence for 3 years, during which we refinanced the mortgage for $50,000. After 3 years we turned it into a rental property and again refinanced as an investment property, this time for $60,000. After putting just over $20,000 in improvements into the property this year and last year we recently sold it for $78,000. My question is, are the capital gains taxes based on the original purchase price 10 years ago or on the amount of the mortgage we just paid off when we sold it?
who is the best person to talk to in my mortgage company about a deed of lieu? The mortgage company just started foreclosure and today i asked if i could do a deed of lieu. My house has been up for short sale since august. The person i spoke to today said i couldnt do one now cause foreclosure already started and that i would recieve a w-99 (i beleive is what it is.) for the full price of the remaining balence due on the house. How much time does it usually take in Missouri for foreclosure? We are filing for bankruptcy in order to relocate for my husband's job. It's going to take at least another month for us to find a place to live and have the money for deposits, etc. The mortgage co. called today and said they are referring it to their foreclosure dept. as of tomorrow. We still have to come up with the filing fee for the bankruptcy as well. We cannot sell the house outright because we are upside down in it. Does anyone have experience with this and can give me an idea of a timeline? If we have to leave before we are able to get the money, we will be living on a campground and I really would not like to do that with three kids.

Foreclosure / Deed in Lieu laws in Missouri What will the process be like??? My husband & I have to sell our first house (we already own our new home) . We have been trying to sell this house since the first of the year, we have tried a short sale, rent to own, even just rent, to get out from under two mortgage payments. However, after two years of trying my husband & I just found out we are expecting! Now, we have to let this other house go back to the bank, as there is no other options. All the realestate agents in my area are telling me that sales are down 32 percent from this time last year. I have contacted my lender & told them of my situation, theyre sending me a short sale package, as well as a deed in lieu package. My question is, is there any reason the bank wouldn't accept a deed in lieu? I have no other liens on the property & it is very comparable to the neighborhood. If not, will they have to abide by MO foreclosure laws since that is where the house is lcoated? MO laws - no defficiency judgements are prohibbited (I won't owe the difference)
My ex defaulted on the mortgage? My ex wife was awarded soul custody of a house and the debt in our divorce. She then got a restraining order against me to keep me off the property. Since that time she has defaulted on the mortgage and sold off the outbuildings that were purchased with the mortgage money and skipped town with some bum from the net and the house is worth a fraction of what it was. It is unlivable due to the windows being knocked out and the doors left open. Is there any legal remedy? I've considered filing for bankuptcy as I am being sued for sixty grand for the mortgage. My income in missouri is around fifty five thousand dollars per year. With the house my total debt is around seventy thousand dollars. Can I file bankruptcy? My ex filed for and got chapter 7 so am I correct in assuming that she wasn't able to file on the mortgage? The house is selling on the courthouse steps in a week and the lawyer for the mortgage company has both of our names on the letter I got saying that we would be sued after the house sells.I can't file bankrupty until after that happens can I? Oh yes, I'm much better off without that witch in my life. The "house" is a 40 foot double wide trailer in a small town and the mortgage is over fifty grand and there's no way to fix that POS up enough to cover the loan. My ex wife got a divorce without my presence and when I tried to take it back to court my lawyer rolled over and played dead because he was friends with her lawyer and the judge, who was also her lawyer in previous court actions. I've tried complaining to the judicial review board and even the bar and got nowhere. I think my best bet is to just go ahead and file bankruptcy, buy used cars for cash and be happy that I don't have to deal with her anymore. Once my mom leaves this earth I will be able to buy a home for cash anyway with the inheritance. I don't use credit cards anyway. I don't deal with credit since I got divorced. What is the starting pay for an HSBC Branch Manager? I wanted to apply for a position with HSBC, but I am not sure that they pay decent for a Branch Manager. Is this a violation of the law? I work for a mortgage broker in Missouri. We are not lisenced in any other states, including Illinois. When we are contacted by customers in Illinois we submit the loan to the lender in another companies name. We have designated phone lines and email accounts for our "Illinois" company. I am concerned that I may be committing wire fraud if I continue originating these loans. If anyone has any information regarding this please share. Thanks.

Need a MISSOURI Attorney concerning real estate, Please read!? Small Town, County Seat in Missouri I was divorced in 2000. My divorce papers read: The parties have agreed that the real property shall become the property of the husband subject to the indebtness theron, with the following exception. Should the property be sold by the husband, then wife shall be entitled to one half the equity. Otherwise, husband shall have in place estate planning which will cause (my sons name) to become owner of the property upon his death. Nowhere in papers does it say I will quit claim, and I remained on deed, mortgage and insurance until about 3 years ago, when he managed to get this refinanced by recording these divorce papers. He first had tried to refinance using my name as well, and I got wind of it, and stopped it. But he found another company and achieved it. I have seen a couple attorneys, who after reading my divorce papers, said I should sue the attorney who wrote them. I have learned recently that he has set up something that causes his new wife to inherit the property/house. Is he not in contempt of court doing this? The kicker to all this, is that the attorney who wrote this was "our" attorney. I was told when these papers were done, it would tie him up so that he couldn't do anything without me. The attorney is also the prosecuting attorney. This property is worth probably $200K. I didn't receive one dime from it when we divorced as I thought that at some point I would get my half. If anyone knows an attorney that would sue another attorney, or tell me how I can put a property lien on it, or get him for contempt, I would gladly appreciate it. I would let an attorney have 50% of a settlement. I have learned it doesn't pay to be fair, and try to do the right thing. Thanks
inherited house capital gains? missouri? hi, i inherited a house its 3 years old worth approx 240,000 and paid off. i have lived here a year now. i want to sell it and pay off the 50,000 mortgage i took out on it and buy a more reasonably sized house with smaller tax payments and pocket the remainder. problem is im not sure how capital gains works and i have heard you cannot sell a house just to buy a cheaper one... any help or advice would be greatly appreciated
If your name is on the deed to a house but not the loan, are you still responsible for the mortgage? My boyfriend and I are expecting a baby and buying a house together. He is still legally married to someone else, although they have been working on getting a divorce for over a year now. Because we live in Missouri, she has to sign the Deed. My question is, even though only his name and mine are on the loan, would she still be responsible for the mortgage since her name is on the deed? And yes, I know she legally owns 1/3 of the property, I'm not worried about that. I'm wooried about her being responsible for the loan b/c I'm afraid if she is, she might not sign. She has also already agreed to sign a quit claim deed after we get the house....
Can 1 spouse sell a jointly owned home without the other's permission? Ok my friend is divorcing her husband and they own a home together. Out of anger the husband will not agree to sell the home and will not give money towards the mortgage, she cannot afford to pay the mortgage alone. She doesn't want to ruin her credit so she wants to just sell the home without his consent and give him his legal share of the proceeds. Is that possible? They are in Missouri.

I've been foreclosed on my mortgage, and the house will sell on the courthouse steps on the 24th of August and I cannot find anyone who can tell me when I have to move out after the foreclosure sale. I've contacted my bank, the attorney representing the bank, the courthouse, sheriff's department, my attorney, and looked on the net. NO ONE can give me a straight answer. I am hoping we have at least 30 days to move, but don't want to be shocked if someone shows up at my door next Thursday and forces us out of the house. Bankruptcy ? for MISSOURI!!!! Help!!!? Ok, i'm going to make this right to point: boy and girl buy house(they are unmarried), they break up, boy signs Quit Claim Deed, girl wont refinance the house even though she lives there and makes the pymts. Boy remarries me!! but old girl is delequent on payments every month and boy's credit is ruined and we now cant buy our own house. (AHHHHH!!) So we are filing bankruptcy b/c our attorney said with chapter 7 we can "surrender" all debt and it will fall onto her responsibility which it already is on her. So we told her what we were doing she got mad and called mortgage company (this is where i need help!!!) Mortgage Co. stated that know matter what type of chapter you file that he will have a repayment plan and will HAVE to now help her make the payments on the house!!! Missouri verbal rental agreement legal rights? My girlfriend and I have been living together for alittle over 3 months now, we have a verbal arrangement that she pays 250$ a month plus her half of the utilities. recently we have been having problems, she has not paid the last months utilities or the rent for the month of october to date... 14th october currently. I asked her to leave, and she refused stating that I had no right to kick her out.. from there she started to become verbally... then physically abusive (no im not a pussy, she is psycho)... when I wouldnt fight back she began breaking my things. I called the police to have her removed before more damage was done. When the police arrived I was treated like a criminal, and they refused to do anything about it, further stating if the returned one of us was going to jail for domestic assault (implying me). Now dont get me wrong I know it is assumed that the male is usually the aggressor, but give me a break. Im not sure if it matters but her 250$ doesnt even amount to a 4th of my mortgage, so things are not by any means divided equally. Is there any way for me to reclaim my house and get this nut job out of MY house before all my things are broken, and I am in jail? Thanks
Where is the best place to get a small home loan with very bad credit in Kansas/Missouri ? My family and I fell on hard times when my husband was diagnosed with a un removable brain tumor (though not cancer) and lost his job in 2003. Technically he is unable to work due to problems associated with the tumor, but disability says that he's not so bad off he can't work. He's tried to find many jobs and even applied to places like burger king, walmart and mcdonalds and was unable to be hired. I worked two jobs but couldn't pay the $1000 mortgage and so we sold the house we had for less than it was worth to a company who kept it from being in foreclosure and on our credit. Still we were paying off credit card bills through Credit consolidation and I couldn't pay them anymore. We have around $10k in cc debt following us around at the moment. A run down trailer was given to us and we have been here for the past three years but it is falling apart and we can't stay here due to sanitary issues. I have two small little girls and they are begging to stay with grandparents to get out of this place. Simple fact is we must move! My husband and I have started our own businesses and make enough to pay a small mortgage fee so we are looking for a house in KS or MO for around 40,000.00 or less that needs some fixing up. I don't know of a place that will help us with our credit as horrible as it is. Any suggestions for places to help us get a small home loan on horrible credit is more than appreciated.

Realtor won't release Earnest money? I am a mortgage broker. My customer was going to buy a house, but decided that they didn't want it cause the Furnace and water heater are broke. Well they put down $500 in Earnest money and got early entry into the home. My customer is paying rent. The realtor refuses to have the seller sign the Earnest money release (title company has it) because she wants it used as a rental security deposit. Customer is buying a different house and wants this money back. Are they entitled to it before moving out? They never signed anything for rental. What happens if l abandon my home after allowing it to go to foreclosure? I own a Michigan home with a mortgage and needed repairs that I can't afford. I put my house for sale, but it hasn't sold for over a year because most people here in Southeast Michigan can't afford to buy a home, and no one wants one with problems. I want to move out of state (Missouri) into an apartment, but I can't afford rent and a mortgage. If I leave my house and stop making payments, it obviously goes into foreclosure, but what are all of my consequences if I don't pay the mortgagee anything? The house gets repossessed, but then what? The mortage that I'm paying is much higher than the value of the house, so my equity is gone. The secretary of the Treasury was literally on his knees begging the speaker of the House not to sabotage the bailout bill. The crash of falling banks made the earth tremble. The Republican presidential candidate suspended his campaign to deal with the crisis. And amid all this, the Democrats in Congress managed to find time to slip language into the bailout legislation that would provide a dandy little slush fund for ACORN. ACORN stands for the Association of Community Organizations for Reform Now, a busy hive of left-wing agitation and “direct action” that claims chapters in 50 cities and 100,000 dues-paying members. ACORN is where Sixties leftovers who couldn’t get tenure at universities wound up. That the bill-writing Democrats remembered their pet clients during such an emergency speaks volumes. This attempted gift to ACORN (stripped out of the bill after outraged howls from Republicans) demonstrates how little Democrats understand about what caused the mess we’re in. ACORN does many things under the umbrella of “community organizing.” They agitate for higher minimum wages, attempt to thwart school reform, try to unionize welfare workers (that is, those welfare recipients who are obliged to work in exchange for benefits) and organize voter registration efforts (always for Democrats, of course). Because they are on the side of righteousness and justice, they aren’t especially fastidious about their methods. In 2006, for example, ACORN registered 1,800 new voters in Washington. The only trouble was, with the exception of six, all of the names submitted were fake. The secretary of state called it the “worst case of election fraud in our state’s history.” As Fox News reported: “The ACORN workers told state investigators that they went to the Seattle public library, sat at a table and filled out the voter registration forms. They made up names, addresses, and Social Security numbers and in some cases plucked names from the phone book. One worker said it was a lot of hard work making up all those names and another said he would sit at home, smoke marijuana and fill out the forms.” ACORN explained that this was an “isolated” incident, yet similar stories have been reported in Missouri, Michigan, Ohio, and Colorado — all swing states, by the way. ACORN members have been prosecuted for voter fraud in a number of states. (See www.rottenacorn.com.) Their philosophy seems to be that everyone deserves the right to vote, whether legal or illegal, living or dead. ACORN recognized very early the opportunity presented by the Community Reinvestment Act (CRA) of 1977. As Stanley Kurtz has reported, ACORN proudly touted “affirmative action” lending and pressured banks to make subprime loans. Madeline Talbott, a Chicago ACORN leader, boasted of “dragging banks kicking and screaming” into dubious loans. And, as Sol Stern reported in City Journal, ACORN also found a remunerative niche as an “advisor” to banks seeking regulatory approval. “Thus we have J.P. Morgan & Co., the legatee of the man who once symbolized for many all that was supposedly evil about American capitalism, suddenly donating hundreds of thousands of dollars to ACORN.” Is this a great country or what? As conservative community activist Robert Woodson put it, “The same corporations that pay ransom to Jesse Jackson and Al Sharpton pay ransom to ACORN.” ACORN attracted Barack Obama in his youthful community organizing days. Madeline Talbott hired him to train her staff — the very people who would later descend on Chicago’s banks as CRA shakedown artists. The Democratic nominee later funneled money to the group through the Woods Fund, on whose board he sat, and through the Chicago Annenberg Challenge, ditto. Obama was not just sympathetic — he was an ACORN fellow traveler. Now you could make the case that before 2008, well-intentioned people were simply unaware of what their agitation on behalf of non-credit-worthy borrowers could lead to. But now? With the whole financial world and possibly the world economy trembling and cracking like a cement building in an earthquake, Democrats continue to try to fund their friends at ACORN? And, unashamed, they then trot out to the TV cameras to declare “the party is over” for Wall Street (Nancy Pelosi)? The party should be over for the Democrats who brought us to this pass. If Obama wins, it means hiring an arsonist to fight a fire For Julie, I did bother to read it and McCain didn't receive any money from that and Keating went to jail. McCain admits it was wrong and is now a big reformer for doing the right thing. Obama is a part of this FM, and FM deal and you don't want to see the truth. Will the press admit that Obama is in the scandal, probably not because they are so stuck on him being "the Messiah" that they are wearing blinders.
I am thinking about just walking away from my home.? I live in a old house that is falling apart. We just refinanced for the third time about 7 months ago. We owe 100,000 for the house and it is only worth 50,000. We pay 1,100 a month in mortgage and we really can not afford that. They just raised our payment up 200 on a 7% fixed rate. We do not want this house anymore, we do not want to negotiate anything. We found something for rent for 400 bucks a month so we will rent that. If we just walk away from our home will they be able to seek a jugement against us? We live in the state of Missouri but our lender is from Florida. Our lender is Taylor Bean and Witaker. Will they garnish our wages? If so how long will it take for them to start garnishing our wages? Will they send us something in writing before they start garnishing our wages so we will have a warning? Thanks for your answers! I have had this house five years. We refinanced thinking that we will get a lower fixed rate, but that is not how it happened. They told us our ARM was about to go up so like fools we signed into this contract. Our payment was only 20 dollars lower now here it is seven months later and they said our taxes and insurence went up which raised our payment 200, which I think is unfair. We received 750 at closing. These people also charged us 450 at closing for an appraisel which I did not see happening.

Kennedy endorses Obama, stroke. Iowa, the first state to vote went to Obama, flooded as well as Montana, Missouri, Kansas, flooding and tornadoes, Illinois and Wisconsin, all states that went to Obama or at least a draw. Pelosi, a strong advocate for Obama is now being investigated for her role in the mortgage debacle! Black Birds attacking pedestrians and cyclists in Chicago now - the city where the DNC moved to support Obama. I have never believed in coincidences and with the number of events cannot help but feel the wrath of God is being felt in so many different parts of our country for electing an individual who comes from a church teaching hatred for his fellow man! Should my boyfriend help pay rent? He moved here from Missouri to live with me and doesnt feel he needs to pitch in a certain amount of money for utilities every check because my ex pays the mortgage on the house that we live in as child support for our son. This left-wing group takes in 40 percent of its revenues from American taxpayers — you and me — and has leveraged nearly four decades of government subsidies to fund affiliates that promote the welfare state and undermine capitalism and self-reliance, some of which have been implicated in perpetuating illegal immigration and encouraging voter fraud. A new whistleblower report from the Consumer Rights League documents how Chicago-based ACORN has commingled public tax dollars with political projects. Who in Washington will fight to ensure that your money isn’t being spent on these radical activities? Don’t bother asking Barack Obama. He cut his ideological teeth working with ACORN as a “community organizer” and legal representative. Naturally, ACORN’s political action committee has warmly endorsed his presidential candidacy. According to ACORN, Obama trained its Chicago members in leadership seminars; in turn, ACORN volunteers worked on his campaigns. Obama also sat on the boards of the Woods Fund and Joyce Foundation, both of which poured money into ACORN’s coffers. ACORN head Maude Hurd gushes that Obama is the candidate who “best understands and can affect change on the issues ACORN cares about” — like ensuring their massive pipeline to your hard-earned money. Let’s take a closer look at the ACORN Obama knows. Last July, ACORN settled the largest case of voter fraud in the history of Washington State. Seven ACORN workers had submitted nearly 2,000 bogus voter registration forms. According to case records, they flipped through phone books for names to use on the forms, including “Leon Spinks,” “Frekkie Magoal” and “Fruto Boy Crispila.” Three ACORN election hoaxers pleaded guilty in October. A King County prosecutor called ACORN’s criminal sabotage “an act of vandalism upon the voter rolls.” The group’s vandalism on electoral integrity is systemic. ACORN has been implicated in similar voter fraud schemes in Missouri, Ohio and at least 12 other states. The Wall Street Journal noted: “In Ohio in 2004, a worker for one affiliate was given crack cocaine in exchange for fraudulent registrations that included underage voters, dead voters and pillars of the community named Mary Poppins, Dick Tracy and Jive Turkey. During a congressional hearing in Ohio in the aftermath of the 2004 election, officials from several counties in the state explained ACORN’s practice of dumping thousands of registration forms in their lap on the submission deadline, even though the forms had been collected months earlier.” In March, Philadelphia elections officials accused the nonprofit advocacy group of filing fraudulent voter registrations in advance of the April 22nd Pennsylvania primary. The charges have been forwarded to the city district attorney’s office. Under the guise of “consumer advocacy,” ACORN has lined its pockets. The Department of Housing and Urban Development funds hundreds, if not thousands, of left-wing “anti-poverty” groups across the country led by ACORN. Last October, HUD announced more than $44 million in new housing counseling grants to over 400 state and local efforts. The White House has increased funding for housing counseling by 150 percent since taking office in 2001, despite the role most of these recipients play as activist satellites of the Democratic Party. The AARP scored nearly $400,000 for training; the National Council of La Raza (”The Race”) scooped up more than $1.3 million; the National Urban League raked in nearly $1 million; and the ACORN Housing Corporation received more than $1.6 million. As the Consumer Rights League points out in its new expose, the ACORN Housing Corporation has worked to obtain mortgages for illegal aliens in partnership with Citibank. It relies on undocumented income, “under the table” money, which may not be reported to the Internal Revenue Service. Moreover, the group’s “financial justice” operations attack lenders for “exotic” loans, while recommending 10-year interest-only loans (which deny equity to the buyer) and risky reverse mortgages. Whistleblower documents reveal internal discussions among the group that blur the lines between its tax-exempt housing work and its aggressive electioneering activities. The group appears to shake down corporate interests with relentless PR attacks, and then enters “no lobby” agreements with targeted corporations after receiving payment. Republicans have largely looked the other way as ACORN has expanded its government-funded empire. But finally, a few conservative voices in Congress have called for investigation of the group’s apparent extortion schemes. This week, GOP Reps. Tom Feeney, Jeb Hensarling and Ed Royce called on Democrat Barney Frank, chair of the House Financial Services Committee, to convene a hearing to probe potential illegalities and abuse of taxpayer funds by ACORN’s management and minions alike. Where does the candidate of Hope and Change — the candidate of Reform and New Politics — stand on the issue? Barack Obama, ACORN’s senator, is for more of the same old, same old subsidizing of far-left politics in the name of fighting for the poor while enriching ideological cronies. It’s the Chicago way.
